David Scott Smith, Esq. is a founding member of Smith & King, LLC and has been practicing law for over twenty years, primarily in the federal and state courts of New York. A member of the New York and California bars, Mr. Smith handles federal and state investigations and prosecutions throughout the country. Mr. Smith also represents individuals, corporations, brokers, and broker/dealers in connection with SEC and FINRA enforcement actions, investigations, litigations, administrative hearings, and arbitrations.
Mr. Smith was a James B. Angell Scholar at the University of Michigan, Ann Arbor and graduated with honors in 1990. He earned his law degree from UCLA School of Law in 1993. Mr. Smith then returned to New York and spent several years as an Assistant District Attorney in the New York County District Attorney’s Office. He was a member of the white-collar crime and narcotics trial and investigation bureaus, where he successfully tried numerous felony cases and ran several high-profile investigations.
Brian King, Esq. is an attorney and founding member of Smith & King, LLC. Since he began practicing law in 2006, Mr. King has focused his work almost exclusively on criminal defense, civil, and securities litigation. In the area of criminal law, Mr. King is proficient at defending clients against any type of criminal charge during the investigative, trial, and appellate stages of a matter at the State and Federal Court levels. His experience ranges from defending basic offenses such as DUI, assault, and drug possession to more complex ones such as mail and wire fraud, securities fraud, money laundering, and enterprise corruption.
Mr. King is also highly adept at handling securities matters before the SEC and FINRA. His experience in SEC matters consists of defending individuals and companies against various claims, including, but not limited to, those alleging market manipulation, insider trading, fraud, mismarking, and selling unregistered stock. Before FINRA, Mr. King represents investors, as well as brokers and brokerage firms, in expungement requests, arbitrations, mediations, and disciplinary proceedings. He has an in-depth knowledge of the unique procedural rules that are applicable in those proceedings and is able to employ the distinctive strategies that are most effective in them. In terms of purely civil law matters, Mr. King concentrates his practice on commercial, personal injury, and employment litigation. Within those three areas, Mr. King is experienced in handling various types of claims, some of which include false arrest, malicious prosecution, breach of contract, civil RICO, negligence, fraud, assault, battery, defamation, intentional infliction of emotional distress, and discrimination.
