David Scott Smith, Esq. is a founding member of Smith & King, LLC and has been practicing law for over twenty years, primarily in the federal and state courts of New York. A member of the New York and California bars, Mr. Smith handles federal and state investigations and prosecutions throughout the country. Mr. Smith also represents individuals, corporations, brokers, and broker/dealers in connection with SEC and FINRA enforcement actions, investigations, litigations, administrative hearings, and arbitrations.
Mr. Smith was a James B. Angell Scholar at the University of Michigan, Ann Arbor and graduated with honors in 1990. He earned his law degree from UCLA School of Law in 1993. Mr. Smith then returned to New York and spent several years as an Assistant District Attorney in the New York County District Attorney’s Office. He was a member of the white-collar crime and narcotics trial and investigation bureaus, where he successfully tried numerous felony cases and ran several high-profile investigations.
After leaving public service, Mr. Smith was a senior associate at the prominent New York City law firm Squadron, Ellenoff, Plesent & Sheinfeld, where he was a member of the firm’s Commercial Litigation, Securities Litigation, and Government Investigations practice groups. In 1999, Mr. Smith joined Stephen Scaring, Esq. on Long Island, and formed the partnership Scaring & Smith, LP. In 2002, Mr. Smith opened his own law practice, the Law Office of David S. Smith, LLC and in 2016, he and his long-time associate, Brian King, formed Smith and King, LLC.
Mr. Smith’s experience as both a prosecutor and private attorney, as well as his tenures in public service, a large law firm, a small law firm and as a solo practitioner make him an extremely knowledgeable and effective advocate for his clients. He is respected by prosecutors, judges and fellow lawyers alike for his careful preparation, zealous advocacy and commitment to his clients and the law. For these qualities, he has been nominated and accepted for membership in the New York Council of Defense Lawyers and the National Trial Lawyers Top 100 Trial Lawyers. He is admitted to practice in New York and California, as well as before the Eastern and Southern Districts of New York and the Second and Ninth Circuits.
